Update
on the Hearing of Citizenship Amendment Act
Currently,
there has been a piece of very popular news about the Citizenship
Amendment Act, which highlights the decision of the Supreme Court to
examine the constitutional validity of the Citizenship Amendment Act.
At the last hearing, the Supreme Court has refused to stay its
operation on reviewing the constitutional validity of the Citizenship
Amendment Act. As per the new amendment of the law, it seeks to grant
the citizenship to the migrants who are non-Muslims, that is
belonging to the Sikh, Hindu, Christian, Buddhist, Parsi and Jain
communities who have come to the country from Bangladesh, Pakistan,
and Afghanistan on or before 31st December 2014. The Supreme Court
asked for its response to the center by the 2nd week of January 2020
on a batch of pleas that are challenging the Citizenship Amendment
Act.
To
specify the bench of appeal comprises Chief Justice S.A. Bobde and
Justices B.R. Gavai and Surya Kant had fixed 59 petitions to the
court, which also includes those filed by the Indian Union Muslim
League and congress leader Jay Ram Ramesh. The decided bench also
agreed to the fact related submission of lawyer Ashwini Upadhyay,
which signifies that the common people should always be made aware
about the objects, aim, and the contents of the Citizenship Amendment
Act. Apart from this, the bench had also asked attorney general K.K.
Venugopal who is representing the center to consider the fact by
using the audio-visual medium for making the citizens of the nation
aware of the legislation. Therefore K.K. Venugopal agreed to the
suggestion of the bench and commented that the government would do
the needful.
Statement
of the Petitioners Opposing the CAA
During
the hearing in the court, the team of lawyers who appeared for the
petitioners asked for a stay on the operation of the new amendments
done in the Citizenship Amendment Act law. But the bench of plea
refused to grant a stay on the operation of the act, thus nullifying
all the facts laid down by the petitioner hailing from Assam. Even
the attorney general opposed the submission of the lawyers of the
petitioners and commented that a law could not stay after it is being
notified for as many as four judgments. The next date of hearing
regarding the arguments on granting stay has been advanced on 22nd
January 2020. As per the senior advocate of one of the parties, it
has been commented that seeking stay is not needed on the operation
of the Citizenship Amendment Act as it has not come into force yet.
Several things are remaining to get activated like the framing of the
rules under the newly amended Citizenship Amendment Act law is yet to
be done. A per the Indian Union Muslim League, who is one of the
petitioners, has challenged the Citizenship Amendment Act stating
that it has violated the fundamental right to equality and has
intended to allow for citizenship to a section of illegal immigrants
by making an exclusion based on religion.
